DOMIQ Website Terms and Conditions

I. General concepts
- Regulations – these regulations.
- Website – the “DOMIQ” website operating at https://domiq.eu
- Service Provider – DOMIQ Sp. z o.o. with its registered office at ul. Daszyńskiego 44, 46-060 Prószków, NIP: 9512272887, KRS: 0000317997, REGON: 141629680,
e-mail: info@domiq.pl, tel.: +48 800 003 098. - Service User – any natural person, legal person or organizational unit with legal capacity, using the Website or services provided via it.
- Electronic Communication – communication between the Parties via electronic mail (e-mail) and contact forms available on the Website.
- Customer – a Service Recipient purchasing products or services via the Online Store.
- Consumer – a natural person performing a legal act not directly related to his or her business or professional activity.
- Entrepreneur – a natural person, a legal person or an organizational unit without legal personality, conducting business or professional activity on its own behalf, concluding a contract via the Online Store in connection with the conducted business or professional activity.
- Online Store – part of the Website enabling you to place orders for physical and digital products and services.
II. General provisions
- The Regulations define the rules for the operation and use of the Website and the rights and obligations of Service Users and the Service Provider.
- The subject of the Service Provider’s services is:
- providing free Website tools,
- enabling access to information content, audiovisual materials, internet applications,
- running an Online Store.
- The content published on the Website is of a general and informative nature and does not constitute advice tailored to the individual situation of the Service User.
- The Service Provider is not responsible for the manner of use of the content by Service Users.
- Use of the Website is at the Service User’s own risk.
- The provisions regarding the exclusion or limitation of the Service Provider’s liability apply only to the extent permitted by applicable law and do not violate the rights of Consumers.
III. Terms of Use of the Website
- Use of the Website is voluntary and free of charge.
- The condition for using the Website is acceptance of the Regulations.
- It is prohibited to use personal data obtained on the Website for marketing purposes.
- Technical requirements:
- a device with Internet access,
- browser compliant with W3C and HTML5 standards,
- JavaScript and cookies enabled.
- In particular, it is prohibited to:
- decompilation and analysis of the source code without the consent of the Service Provider,
- interference with the Website’s security,
- actions that cause excessive server load,
- uploading or injecting malware,
- activities that may compromise data security.
- If a cybersecurity incident or a violation of the GDPR is detected, the Service User should immediately inform the Service Provider.
IV. Communication and services available on the Website
- The website enables interaction through:
- contact form,
- Internet shop.
- The Service Provider’s contact details are available on the Website.
- Personal data is processed in accordance with the Privacy Policy.
V. Rules for concluding contracts and fulfilling orders
- Sales contracts are concluded via the Online Store.

- It is not possible to place an order without having an active account.
- After placing an order, the Customer receives an automatic email. The order is processed after manual confirmation by the Service Provider.
- The sales contract is concluded upon manual confirmation of the order by the Service Provider.
- The service provider issues VAT invoices.
- Prices in the Store are presented net. Gross prices (including VAT) are clearly marked.
- Delivery costs are each time specified separately.
- Sales are conducted globally, with Poland being the country of tax settlement.
VI. Płatności
- Payments are made via the PayNow system, operated by mElements S.A.
- Payment is due immediately unless the offer states otherwise.
- Available currencies: PLN and EUR.
- The order processing time is counted from the moment the funds are credited to the Service Provider’s account.
- PayNow may accept card payments with the following cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro (subject to current availability from the payment operator).
VII. Right of withdrawal
- The right to withdraw from the contract applies only to Consumers referred to in Article 22¹ of the Consumer Rights Act.
- Entrepreneurs concluding contracts within the Online Store, including persons conducting business activity or performing craft activities, do not have the right to withdraw from the contract within 14 days, unless the parties agree otherwise in the content of the offer.
- The right to withdraw from the contract does not apply in the cases specified in Article 38 of the Consumer Rights Act, in particular in relation to personalized products and those made to the Customer’s individual order.
- In the case of contracts for the supply of digital content that is not recorded on a tangible medium, the Consumer loses the right to withdraw from the contract at the time of commencement of performance if all of the following conditions are met:
- The consumer has given his/her express consent to commence performance before the expiry of the withdrawal period,
- The consumer was informed about the loss of the right to withdraw from the contract,
- The Service Provider provided the Consumer with confirmation of the conclusion of the contract on a durable medium.
The consent referred to above is expressed when placing an order by checking the appropriate checkbox.
Withdrawal should be reported by e-mail to the following address: info@domiq.pl.
- In the event of effective withdrawal from the contract, the goods will be returned to the registered office address of the Service Provider.
- A declaration of withdrawal from the contract may only be submitted by an entity entitled to exercise the right of withdrawal.
- If the content of the order or the data provided by the Customer indicates that the person submitting the declaration of withdrawal is not a Consumer within the meaning of the law, the Service Provider may refuse to accept the withdrawal from the contract, informing the Customer thereof electronically.
- A purchase made by an Entrepreneur is, in particular, an order in which the Customer provided a Tax Identification Number (NIP) or data for issuing a VAT invoice to an entity conducting business or professional activity.
- The refund will be made no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract, using the same payment method used by the Customer, unless the Customer has expressly agreed to a different refund method.
- In the case of payment by payment card, the refund is made to the same card (to the card account), unless the law or the payment operator’s regulations provide otherwise.
VIII. Delivery
- Delivery is carried out within Poland and worldwide.
- Delivery methods:
- delivery,
- parcel lockers.
- Estimated delivery time: up to 2 business days, unless the offer states otherwise.
- Digital products are not subject to physical delivery.
- The delivery cost is always indicated in the Online Store before placing the order.
IX. Complaints
- Complaints should be submitted electronically.
The complaint should include:- order number,
- description of the problem,
- photos, if necessary.
- The Customer has the right to file a complaint regarding non-conformity of the goods with the contract or defects in the goods within the time limits and under the terms specified in generally applicable legal provisions.
- In the event of damage to a shipment during transport, the Customer should submit a complaint directly to the entity performing the delivery. Filing a complaint with the carrier does not exclude or limit the Service Provider’s liability to the Consumer under applicable law.
- The cost of returning the product to the Service Provider is borne by the Customer, and the cost of reshipment is borne by the Service Provider. The cost of returning the product to the Service Provider is borne by the Customer, subject to cases where applicable law grants the Consumer other rights, in particular regarding liability for non-conformity of the goods with the contract.
- Complaints are considered within 14 days.
X. Data collection and cookies
- In order to properly provide services through the Website, to protect the legal interests of the Service Provider and to ensure compliance of the Website with applicable law, the Service Provider collects and processes certain data about Users via the Website.
- In order to properly provide services, the Website uses and saves some anonymous information about the Service User in cookies.
- The scope, purposes, method and principles of data processing are available in the annexes to the Regulations: “GDPR Information Obligation” and in the “Privacy Policy“, which constitute an integral part of the Regulations.
- Data collected automatically:
To ensure the smooth operation of the Website and for statistical purposes, we automatically collect certain data about the Service User. This data includes:- IP address
- Browser type
- Screen resolution
- Approximate location
- Opened subpages of the website
- Time spent on the relevant subpage of the website
- Type of operating system
- Address of the previous subpage
- Referrer address
- Browser language
- Internet connection speed
- Internet service provider
- Anonymous demographic data based on Google Analytics data:
- Sex
- Age
- Interests
- Anonymous data necessary for serving advertisements:
- Remarketing data
- Data related to reporting on displayed advertisements
- The above data is obtained via the Google Analytics script and is anonymous.
XI. Prawa autorskie
- The owner of the Website and the copyright to the website is the Service Provider.
- Some of the data posted on the Website are protected by copyright belonging to companies, institutions and third parties not related in any way to the Service Provider, and are used on the basis of obtained licenses or based on a free license.
- Pursuant to the Act of 4 February 1994 on Copyright, it is prohibited to use, copy, reproduce in any form or store in search systems, excluding the Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn search engines, any articles, descriptions, photos and any other content, graphic, video or audio materials found on the Website without the written consent or consent transmitted via Electronic Communication of their legal owner.
- Under the Copyright Act of 4 February 1994, simple press releases, understood as information alone, without commentary or assessment by the author, are not protected. Authors understand this to mean the right to use information from texts posted on the website, but not to copy all or part of the articles unless otherwise indicated in the individual material made available on the website.
XII. Amendments to the Regulations
- The Service Provider reserves the right to change the Regulations for important reasons, in particular:
- change in legal regulations,
- change in the scope of services provided,
- technological changes
- organizational changes to the Website.
- Amendments to the Regulations do not violate the acquired rights of Service Recipients, in particular the rights of Consumers resulting from previously concluded contracts.
- Service Users will be informed about changes to the Regulations by publishing their new content on the Website.
- Amendments to the Regulations come into effect within 7 days from the date of their publication, unless mandatory provisions of law provide otherwise.
- Using the Website after the entry into force of changes to the Regulations constitutes acceptance thereof, provided that this provision does not apply to contracts concluded before the date of the change to the Regulations.
XIII. Final Provisions
- Contact with the Service Provider is possible only in matters related to the Website.
- Contracts are concluded in Polish.
- The applicable law is Polish law.
- Any disputes arising from contracts concluded via the Website will be resolved by the court having jurisdiction over the registered office of the Service Provider, subject to the rights of Consumers under applicable law.
- The parties allow for the possibility of amicable settlement of disputes, including mediation.
- Current and archived versions of the Regulations are available on the Website.
- The Service Provider reserves the right to assign, in whole or in part, all of its rights and obligations related to the Service, without the consent or possibility of any objection by Service Users. The above provision does not violate the rights of Consumers arising from mandatory provisions of law.
- The Service Provider will make every effort to ensure that the Website’s services are offered continuously. However, the Service Provider assumes no liability for disruptions caused by force majeure or unauthorized interference by Service Users, third parties, or the activities of external automated programs.
- The Service Provider reserves the right to temporarily, completely or partially disable the Website in order to improve it, add services or carry out maintenance, without prior notice to the Service Users.
- The Service Provider reserves the right to permanently disable the Website without prior notice to Service Users.
